I was wondering how far they go back on your credit cards?I mean, if you used it for food and then filed 3 weeks later,do they make you pay that back?

I don't have personal experience with this, but a friend of mine filed and I think she said it was 3 months. I can't swear to that, but I think that is what she said.

I prepare the BR forms for my husband who is an attorney and does BRs. Although it's Federal, each state had different exemption policies. If you are filing, you really shouldn't have anything left after the exemptions to pay your creditors. If you do, then I think the creditors get paid from the oldest debt first, but I have to check. My husband's clients have not had any funds left for paying creditors since I've been doing the paper work, so I'm not really sure what happens. I'll find out when he gets home.

This site is a great source of information - if you can't find the answer in the archives, you can post a question yourself...

Well we went bankrupt, but we had no credit cards, we had to file because we had a business that fell through and payments were way to high, and thier just was not eneough business to keep us going. The way it worked here in b.c we had to write all our expenses every month, we were aloud to make x amount, if we made more than that amount then x amount had to go to the lawyer to distrube to the people we owed, plus we did not recieve any gst cheques that went straight towards the debt. We did get to keep our family allowance though. We did this for 1 year. To answer your question I really do not know, but if you had to buy food, food it is. I do not think they make you pay that back if you used it then filed 3 weeks later. Also a little info we were told we would not get another mortgage for 7 years within two years we bought a house through a bank. We had did a rent to buy it was all done up with a lawyer etc.. and made insurance payments for our car every month, which counted as credit. The mortgage we got was found through a mortgage broker so it actually cost us 2,000. for that but was put on top of what we borrowed for the house. The only negative thing that happened to us after we filed I seen the lady who was doing our books for the business, and she ran after me in a parking lot screaming I could not go bankrupt on her, and I owed her 117.00. I tell you I could not get out of that parking lot fast eneough. You will feel better once it is all over. Hang in their.
